Membership & Package Terms & Conditions
MEMBERSHIP
1.Your membership commences once you have signed your membership application, unless an agreed to delay commencement to a pre-approved date.
2.Memberships are valid for a one year period commencing from the date your membership application has been signed.
3.Memberships are non-refundable & non-transferrable.
4.You agree to advise us immediately of any change to the Members details provided.
5.Your membership cannot be on frozen.
6.After purchasing a membership, Members are required to train either by selecting a per class option, a monthly package or choose a 3 monthly pre-pay package. These packages & prices can be viewed at www.martialfitnessonline.com as well as www.martialfitness.com.
MONTHLY PACKAGE STANDING ORDER FEES AND CHARGES
1.Your first month's monthly training package payment will be collected from you by us at Reception either by Debit / Credit Card or cash at time of joining or on commencement of starting a monthly package as applicable. Online payments are also permitted however must be verified by Reception before a package can be activated.
2.Your ongoing monthly payment will be set up to be an automatic standing order payment issued from yourself to Martial Fitness on the same date as agreed every month.
3.Reception will send you a confirmation message detailing your new standing order include account information & payment date to assist your set up procedure. Please contact us directly if you require further assistance. Reception will also issue a reminder message approx. 1 week prior to your second standing order payment.
4.Thus, your second standing order monthly package payment will be collected one month after your package was commenced. Subsequent standing orders for monthly package fees will be due on the same date monthly thereafter. Each payment made is not refundable.
5.If any standing order is returned unpaid or if any other form of payment is not honoured for whatever reason, you may incur an administration fee of £10. If, despite us having notified you of a missed payment/s, further payments are missed, we reserve the right to, at our sole election, either suspend or terminate monthly packages & convert you to a per class status. We may present an option to reduce the administration fee if the outstanding amount is paid online within 24 hours days of a failure notification/becoming due.
6.Reception will notify you within 24hrs of a failed payment (Mon-Fri).
7.If you are looking to upgrade your package e.g. from Basic to Standard, this should be done through Reception. If upgrading mid-month, a balance for the remaining period of that month may be required. This will be agreed with you via Reception. Members must adjust the on-going monthly standing order payment directly with their bank.8.If requiring to freeze or cease a monthly standing order, Reception will require a 7 day notification period advising us of a change of circumstance. Members are required to freeze/cease any ongoing payments with their bank directly. Any payments STANDING ORDER
PRICES
1.From time to time we may need to increase the price of memberships or packages We will give you at least 1 full months' notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership/monthly package will cost after the increase. During this period, you will have your usual right to change to an alternative payment plan/package by just informing us & adjusting your payment with your bank directly.
TERMINATION
MONTHLY STANDING ORDER PACKAGES
1.You may terminate your package at any point by notifying us & cancelling your standing order with your bank, please allow at least 4 working days for your bank to action this.
2.In the above circumstances your membership will remain in force until the day before your next payment is due, at which point it will automatically terminate.
GENERAL TERMS & CONDITIONS
1.Members must be 18yrs or older to sign a members application form. Anyone under this age must have the form completed & signed by either a parent or guardian.
2.You agree to comply with the Rules of Membership which relate to your conduct & are displayed prominently in the Club as well as on our websites. We may make reasonable changes to these Rules at any time provided that we give you advance notice of the change.
3.If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of any agreement strictly at a future date.
4.There may be occasions where we have to close all, or part of, the dojo. We will do our best to let you know of such closures in advance of them taking place, this will only occur if the problem is urgent or an emergency. We will use all commercially reasonable endeavours to ensure that such closures are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your fees in such circumstances.
5.We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.
6.We will not be liable or responsible for outstanding monies paid or services owed by a Personal Trainer who is not directly engaged by Martial Fitness.
7.This agreement is governed by English Law.
8.We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.9.To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in any class, activity or exercise and that such class, activity or exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. Further, that you will advise us immediately should your circumstances change.
